Terms of Service

1. Agreement

RizzGen is a sole proprietorship operated by Meet Animeshbhai Gondaliya, having its place of business at Priya, 2 Fulwadi Park, Nana Mauva Road, Rajkot, Gujarat 360005, India. In these terms, “RizzGen”, “we”, “us” and “our” mean that business, and “you” means the person or organisation using the Services.

“Services” means www.rizzgen.ai, the RizzGen studio at app.rizzgen.ai, and every related product that links to these terms. By creating an account or using the Services, you agree to these terms, to our Privacy Policy, our Acceptable Use Policy and our Refund & Cancellation Policy, each of which forms part of this agreement. If you do not agree, do not use the Services.

We may change these terms. When a change materially affects your rights or obligations we will notify you by email or in the studio at least 14 days before it takes effect, and continuing to use the Services after that date means you accept the change. If you do not accept it, you may close your account and request a refund of unspent credits under the Refund & Cancellation Policy.

2. Eligibility

You must be at least 18 years old to create an account or buy credits. By using the Services you confirm that you are 18 or older and that you have the legal capacity to enter into this agreement. If you are using the Services on behalf of an organisation, you confirm that you are authorised to bind it, and “you” means that organisation.

You may not use the Services if you are barred from doing so under the laws of India or any other applicable jurisdiction, or if we have previously terminated your account.

3. Your account

You must give accurate registration information and keep it current. You are responsible for everything that happens under your account and for keeping your credentials secure. Tell us immediately at [email protected] if you suspect unauthorised access, and we will revoke your active sessions.

One person or organisation per account. Do not share credentials, resell access, or create accounts by automated means.

4. Credits

The Services run on credits. There is no subscription and no recurring charge — you buy credits when you want them, and nothing is billed automatically.

Each generation consumes credits according to the model you choose, the resolution and the duration. The studio shows you an estimate before you commit, and records the actual cost afterwards. Estimates are close but not exact, because the real cost depends on what the model returns.

Credits do not expire. They remain on your account for as long as the account is open.

If a generation fails through a fault on our side or a provider’s, the credits for it are automatically refunded to your balance. Credits have no cash value outside the Services, cannot be transferred between accounts, and cannot be exchanged for anything other than use of the Services — except under our Refund & Cancellation Policy, which lets you recover unspent credits within 60 days of purchase.

Prices are shown in the studio and may change. A change never affects credits you have already bought. Taxes are charged where applicable.

5. Your content and your outputs

“Your Content” means everything you put into the Services: prompts, briefs, scripts, images, video, audio, documents, brand context and chat messages. “Outputs” means the media the Services generate for you from it.

As between you and RizzGen, you retain all rights in Your Content, and you own the Outputs generated from it. We assign to you whatever rights we may have in the Outputs, to the extent they are capable of ownership. You may reproduce, modify, publish, distribute, sell and commercially exploit your Outputs without restriction from us, and without attribution.

This is subject to three things. First, you must have paid for the generation — we may withhold or revoke the rights granted here for Outputs produced through fraudulent or unpaid use. Second, your Outputs must not breach section 8. Third, you are responsible for having the rights to Your Content: if you upload a photograph, a logo, a song, a person’s likeness or a voice recording, you confirm that you own it or have permission to use it for this purpose.

Note that copyright law in most countries, India included, is unsettled on whether AI-generated material attracts copyright protection at all. We give you every right we can give you. We cannot promise that a court will recognise an exclusive copyright in an Output, because that is not ours to promise.

6. The licence you grant us

To operate the Services we need permission to handle Your Content. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, reformat and display Your Content and your Outputs, and to send them to the AI providers described in our Privacy Policy, solely for the purpose of providing the Services to you, keeping them secure, and complying with the law.

This licence is limited to running the product. It does not let us train AI models on Your Content, sell it, or use it to promote RizzGen. We only feature your work publicly if you publish it yourself under section 7, or if you give us separate written permission.

The licence ends when you delete the content or your account, except for copies we must retain under the retention periods in the Privacy Policy, and for anything you published publicly before deleting.

7. Publishing and sharing

The Services let you make work public in two ways: share links, which give anyone holding the address a read-only view of a chat, and Takes, which publish a finished video to a public page and may appear in our showcase.

When you publish, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute that content for as long as it remains published, including displaying it in the showcase and in listings of public work. You keep ownership throughout.

You can revoke a share link or unpublish a Take at any time, and we will stop displaying it. We cannot retrieve copies other people made while it was public, and we cannot remove it from third-party caches and search indexes beyond requesting removal.

Published content is subject to moderation under section 9. We may unpublish anything that breaches section 8 without notice.

8. Acceptable use

Our Acceptable Use Policy sets out what you may not create, upload or publish through the Services. It forms part of these terms and breaching it breaches this agreement.

In summary, and without limiting that policy, you must not:

• create or upload sexual content involving minors, in any form, ever;
• create sexual content involving real people without their consent, or non-consensual intimate imagery;
• clone a voice or use a person’s likeness without their documented permission;
• create content that incites violence, promotes terrorism, or harasses or defames anyone;
• create deceptive content impersonating a real person or organisation, including material intended to mislead voters or defraud people;
• upload material you do not have the rights to, or use the Services to infringe copyright or trademarks;
• break Indian law or the law where you are;
• reverse-engineer, scrape, overload or circumvent the technical limits of the Services, or use them to build a competing product;
• evade a suspension, or resell access to the Services.

9. Moderation and suspension

We screen prompts and uploaded images through automated content moderation before a generation runs. Content that breaches section 8 is blocked, and the block is recorded against your account with the categories that triggered it.

Repeat violations lead to suspension. Accumulating three or more flags within a rolling 30-day period suspends your account pending review. We may change these thresholds as we learn what works.

Content sexualising minors carries zero tolerance. It is blocked immediately, your account is suspended immediately without warning, and we will report it to the authorities where the law requires.

Automated moderation is imperfect and sometimes blocks legitimate work. If you believe a block or suspension is wrong, write to [email protected] and a human will review it. We aim to respond within 72 hours.

Credits consumed by a blocked generation are refunded. Credits are not refunded for generations that completed before a suspension.

10. Connected accounts

You may connect an Instagram or YouTube account so the Services can study your existing content and match its style. By connecting, you confirm you are authorised to do so and that connecting does not breach that platform’s terms. Your use of those platforms remains governed by their terms, not ours.

We store the access token encrypted and use it only for the purpose you connected it for. Disconnect at any time from your settings; we then revoke our access and delete the token. We are not responsible for changes a platform makes to its API that break or limit a connection.

11. How AI generation works, and what it cannot promise

You should understand several things about generative AI before relying on the Outputs.

• Outputs are not unique. The same or a similar prompt can produce similar results for someone else. We cannot promise your Output is unique, and we grant you no exclusivity over it.
• Outputs may resemble existing work. Models are trained on large datasets and can produce material resembling existing styles, characters, brands or people. You are responsible for checking that what you publish does not infringe someone else’s rights.
• Outputs may be wrong. Generated scripts, claims, figures, captions and translations can be inaccurate or misleading. Check anything factual before you publish it. The Services are not a substitute for professional advice of any kind.
• Results vary. The same prompt run twice will produce different results. We do not guarantee any particular quality, style or outcome, and dissatisfaction with a result is not a fault in the Services.
• You are responsible for what you publish. Disclosing AI generation where the law or a platform requires it is your obligation.

12. Third-party model providers

Generation runs on models operated by independent companies, described in section 6 of our Privacy Policy. Using the Services means your content is sent to whichever of them the model you select requires, and their terms and acceptable-use policies apply to that processing in addition to ours.

We choose providers carefully, but we do not control them. We are not liable for a provider’s outage, price change, content restriction, or decision to withdraw a model. When a model becomes unavailable we will route to an alternative where one exists, which may change the character or cost of a generation.

13. Availability, changes and beta features

We aim to keep the Services available but do not guarantee uninterrupted access. We may suspend access for maintenance, and we may modify, add or remove features. Where a change removes something you depend on, we will give reasonable notice if we can.

Some features are released as beta or experimental. These are provided as-is, may behave unpredictably, may consume credits inefficiently, and may be withdrawn without notice. Use them knowing that.

We are not liable for loss of content resulting from a failure on our side beyond restoring from our most recent backup. Keep your own copies of work that matters — you can export Outputs at any time.

14. Termination and account deletion

You may stop using the Services and delete your account at any time from your settings. Deletion suspends the account immediately and schedules permanent erasure 15 days later, during which you can restore everything by signing back in. After that window, erasure is permanent and irreversible.

Unspent credits may be refundable under the Refund & Cancellation Policy if you are within 60 days of purchase. Request the refund before deleting the account.

We may suspend or terminate your account if you breach these terms or the Acceptable Use Policy, if required by law, or to protect the Services or other users. Except where a breach makes it inappropriate, we will tell you why and give you a chance to respond. If we terminate your account without cause, we will refund your unspent credits in full regardless of the 60-day window.

Sections 5, 6, 11, 15, 16, 17, 18 and 19 survive termination.

15. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, secure or error-free.

We make no warranty about the accuracy, quality, originality, legality or suitability of any Output, or that any Output will achieve a commercial result. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

16. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, business opportunity or data, however caused and on any theory of liability, even if advised of the possibility.

Our total aggregate liability arising out of or relating to these terms or the Services is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim. Where you have paid us nothing in that period, our liability is limited to ₹1,000.

This limit does not apply to liability that cannot lawfully be limited, or to your obligations under section 17.

17. Indemnity

You will indemnify and hold harmless RizzGen and Meet Animeshbhai Gondaliya against any claim, demand, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of or relating to: Your Content; your use of the Outputs; your breach of these terms or the Acceptable Use Policy; your infringement of another person’s intellectual property, privacy, publicity or personality rights; or your breach of any applicable law.

We will notify you promptly of any claim to which this applies, and you may control the defence provided you do not settle in a way that admits liability on our behalf or imposes an obligation on us without our written consent.

18. Governing law

These terms, and any dispute or claim arising out of or in connection with them or their subject matter — whether contractual or non-contractual — are governed by and construed in accordance with the laws of India, without regard to conflict-of-laws principles.

19. Jurisdiction

The courts at Rajkot, Gujarat, India have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these terms or their subject matter. You and we both submit to that jurisdiction.

Before filing, we ask that you contact us at [email protected] so we can try to resolve the matter directly. Most disputes are settled faster that way. Nothing in this paragraph prevents either party from seeking urgent injunctive relief.

Nothing here deprives you of the protection of mandatory consumer-protection laws of the country where you live, including your right to bring proceedings before a consumer forum where that right applies.

20. Grievance redressal

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, our Grievance Officer is:

We acknowledge grievances within 24 hours and resolve them within 15 days. To report content that infringes your copyright or trademark, or that breaches the Acceptable Use Policy, write to the same address with enough detail to identify the content and your rights in it.

21. Contact

These terms, together with the Privacy Policy, Acceptable Use Policy and Refund & Cancellation Policy, are the entire agreement between you and us about the Services. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it in connection with a transfer of the business.
